Abstract: A device for holding a mouth of a plastic bag in an open position is molded of a plastic material that includes a finger hole and locking slot for retaining the bag within the device. The locking slot includes a directing member for maintaining a free end of a bag tail in the locking slot. This arrangement preferably is molded as a one piece product and has been found to be adaptable to bags of different capacities and materials. In a preferred embodiment, two finger holes are provided with each finger hole having a locking slot and directing member. (end of abstract)

[0001]This application claims priority from U.S. Provisional Application Ser. No. 06/779,416 filed Mar. 7, 2006.

FIELD OF THE INVENTION

[0002]The present invention relates to a bag holder for use in holding plastic garbage bags in an open position to simplify the placement of refuse or yard waste in the plastic bag.

BACKGROUND OF THE INVENTION

[0003]There are a number of known garbage bag supports that are used to maintain the mouth of a garbage bag in an open configuration. Some of these devices include various clamping arrangements for effectively engaging the periphery of the bag after the bag has passed over the actual device that is clamped on the outside.

[0004]One such device is shown in my earlier U.S. Pat. No. 4,775,123 that discloses a one piece structure where the mouth of a garbage bag is passed through the center of the bag holder and the edge of the bag is wrapped over the top of the device and is retained on the side of the structure. In particular, this arrangement includes at least two finger holes in the side of the body member where a portion of the bag to the exterior of the holder is passed through the finger hole to form a bag tail and this bag tail is then passed through a locking slot provided at a bottom edge of the holder. This device operates satisfactorily with some garbage bags, however, there is a tendency due to the natural slip characteristics of a plastic garbage bag that the tail of the garbage bag is not maintained by the locking slot. This problem is further compounded by the use of larger garbage bags, as well as new materials that are used for some higher capacity garbage bags.

[0005]With my prior structure, when a certain weight (approximately 20 lbs.) is received in a garbage bag, there is a tendency for the garbage bag to slip and not be retained by the bag holder. As can be appreciated, with my earlier structure, the mouth of the bag is essentially gathered around the flared top edge of the bag holder and is drawn into engagement with the bag holder by forcing a portion of the bag through the finger holes to form two tails of the bag. These tails extend downwardly from the finger holes and are brought up into engagement with the locking slots.

[0006]With recent improvements in the materials of the bags, heavier loads are now more common and this slippage problem is more frequent.

[0007]The clamping arrangements of the other prior art structures are either less cost effective to produce or also suffer from this slippage problem.

[0008]A revised arrangement has been developed to avoid the slippage problem and allow the bag holder to operate with a host of bags of different materials, sizes and capacities.

SUMMARY OF THE INVENTION

[0009]A garbage bag support according to the present invention is designed for holding a mouth of plastic waste bag in an open position and comprises a tubular body having an upper edge and a lower edge with a center port extending between the upper and lower edges. The tubular body between the upper and lower edges includes at least two finger holes, with each finger hole receiving a tail portion of the plastic waste bag. The tail portion is formed by inserting an edge portion of the waste bag through the respective finger hole. Each finger hole includes an associated locking slot positioned to receive the respective tail portion and retain the tail portion in the locking slot opposing any tension force exerted on said tail portion due to material retained in the bag. Each locking slot includes a directing member positioned to maintain a locking orientation of a free end of the respective tail portion relative to the locking slot whereby the waste bag maintains securement in the locking slot during use of the plastic waste bag.

[0010]According to an aspect of the invention, the directing member is a cantilevered tab secured at one side of the locking slot and extending across the locking slot and defining a narrow gap therebetween.

[0011]According to a further aspect of the invention, the cantilevered tab has an upper edge above an upper edge of said locking slot.

[0012]According to yet a further aspect of the invention, wherein the cantilevered tab includes a free end generally parallel to the locking slot with a cam edge for slide insertion of the tail portion under the cantilevered tab.

[0013]In yet a further aspect of the invention, each locking slot is provided in the lower edge of the tubular body and the directing member is provided on an exterior surface of said tubular body.

[0014]In yet a further aspect of the invention, the device is a one piece molded product.

[0015]In yet a further aspect of the invention, the tubular body includes a straight side joined by an arcuate portion to form a generally `D` shape tubular body.

[0016]In another aspect of the invention, the straight side at the upper edge includes an outwardly extending tapered edge for sweeping of material into the plastic waste bag.

[0017]In yet a further aspect of the invention, the arcuate portion of the upper edge includes an outwardly projecting curved flange.

[0018]In yet a further aspect of the invention, the locking slot and the tab member are formed in an inwardly offset region of the tubular body.

[0019]In yet another aspect of the invention, the tab is generally flush with the exterior of the tubular body either side of the tab.

In yet another aspect of the invention, the lower edge of the tubular body includes two reset areas defining molded hand grips.

[0020]In a further aspect of the invention, the upper edge of said tubular body progressively widens to provide a funnel like transition with the tubular body.
